1. About These Terms

These Terms & Conditions govern purchases from and use of bhagwatisons.com, operated by Setmore Exim Pvt. Ltd. under the Bhagwati Sons brand (“we”, “us” or “our”).

Please read these Terms together with our Shipping Policy, Return, Refund & Cancellation Policy and Privacy Policy before placing an order. Nothing in these Terms excludes rights or remedies available under applicable Indian law.

2. Eligibility and Customer Information

Purchases must be made by a person aged 18 or above who is legally competent to contract, or by an authorised representative of a business.

Please provide accurate contact, delivery, billing and GST details where applicable. Keep account credentials secure and notify us promptly of suspected unauthorised use.

You must not use the website for fraudulent transactions, unlawful activities, impersonation or interference with its security.

3. Product Information and Compatibility

Please check the selected model, colour, size, specifications, supplied accessories, compatibility, warranty and delivery terms before purchasing. Contact us if you need clarification.

Product photographs may show optional accessories or illustrative settings; included items will be identified in the product description. Minor differences caused by screen settings do not justify a materially different product being supplied.

Features dependent on subscriptions, apps, internet access or third-party services are subject to the relevant provider’s terms. Any known material requirements or additional charges will be disclosed before purchase.

We remain responsible for the accuracy of material descriptions and representations made by us.

4. Prices, Taxes and Offers

Prices are displayed in Indian Rupees. Applicable taxes, delivery charges and other compulsory charges will be disclosed before payment.

Offers apply only to the products, variants, quantities and periods specified. Discounts cannot be combined unless expressly stated.

Prices may change for future purchases. We will not increase the agreed price of an accepted order without your consent.

If a material pricing or listing error affects an order, we will contact you to explain the correction. You may accept the corrected offer or receive a refund if the order cannot proceed. We will not debit an additional amount without authorisation.

5. Orders and Acceptance

An automated order acknowledgement confirms receipt of your request. Order acceptance is communicated through a specific acceptance or dispatch confirmation, unless an earlier written agreement applies.

Orders are subject to stock availability, delivery serviceability, successful payment and reasonable verification.

We may decline an order for a legitimate reason, such as unavailable stock, an unserviceable address, a material listing error or reasonable evidence of fraud. We will communicate the reason where legally permissible and refund payments for orders we cannot fulfil.

These provisions do not permit arbitrary cancellation or avoidance of commitments already made.

6. Payments and Verification

Use only payment methods offered through our checkout or payment instructions verified directly with us.

We may request proportionate verification where reasonably necessary to prevent fraud. We will never ask you to disclose a card PIN, CVV, OTP or banking password to our staff.

Payment processing and bank credit times depend partly on the relevant provider. This does not exclude our obligations to initiate and complete refunds as required by law.

7. Retail, Wholesale and Corporate Orders

We welcome retail, wholesale and corporate gifting enquiries. Bulk quantities may require a separate quotation and written confirmation of stock, pricing, payment and delivery arrangements.

Any special commercial conditions must be agreed before payment. Consumer rights apply wherever the purchaser qualifies for protection under applicable law.

8. Pre-orders, Special Orders and Advances

For pre-orders, customised products or products imported against an order, the applicable specifications, estimated delivery period, advance payment and cancellation conditions will be disclosed before payment.

A delivery period or advance requirement advertised for one product does not automatically apply to other products.

Advances are adjusted against the agreed order value. They are not automatically forfeited merely because they are described as an advance or booking amount. Any cancellation deduction must be lawful, reasonable and based on terms disclosed and agreed before payment.

We will inform you of material delays and provide the remedies required by applicable law.

9. Shipping, Delivery and Collection

Delivery serviceability, charges and timelines are governed by our Shipping Policy and the terms disclosed for the individual order.

Please provide a complete address and an accessible contact number. Any reasonable additional charges caused by an incorrect address, requested redirection or customer-related failed delivery will be explained and must be lawful.

Installation, demonstration or assembly is included only where expressly stated. Otherwise, availability and charges should be confirmed before purchase.

For store collection, please inspect visible condition and supplied items. Collection or delivery acknowledgement does not waive claims for concealed defects or other legal rights.
